Summary of our terms and conditions

Gemma is an “open source” and “open science” project intended to add value to publicly-available genomics data through curation and re-analysis. We make the data, annotations and analysis results available to the scientific community through the Gemma web site as well as an API and software packages for R and Python.

The use of Gemma is covered by certain licenses and terms, summarized here.

• The source code of Gemma is available under the Apache 2.0 license.

• The gene expression data (expression levels) in Gemma are available under the same license under which they were released by the data provider from which we obtained it. That provider is generally indicated by the “Source” shown on our web pages for each data set. For example, data from GEO has “no restrictions on use or distribution” by default. If no such license or disclaimer is stated by the provider, we make the data available under the Creative Commons CC-BY license and note that the attribution requirement in that case extends to citing the publication for the original production of the data as well as Gemma.

• The data annotations (e.g. dataset descriptive tags), sample annotations (e.g. experimental design annotations), and analysis results (differential expression, coexpression, data set diagnostics and the like) and platform gene annotations (based on our sequence alignments) we create are made available under the Creative Commons CC-BY-NC license. Parties interested in licensing these components of Gemma for inclusion in commercial products use should contact us.

• Under all use scenarios, we ask that you cite one of our relevant publications (e.g. here or here).

• Use of the Gemma web site, APIs, data, code, and annotations come with no warranty or promise of suitability for any purpose. Use at your own risk.

UBC WILL NOT BE LIABLE TO YOU, OR ANY OTHER PERSON OR ENTITY FOR ANY LIABILITY, LOSS OR DAMAGES CAUSED OR ALLEGED TO HAVE BEEN CAUSED, EITHER DIRECTLY OR INDIRECTLY, BY YOUR USE OF OR INABILITY TO USE THE UBC SERVICES, OR FOR ANY USE OF YOUR DATA BY THIRD PARTIES. WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL UBC BE LIABLE FOR ANY LOST REVENUE, PROFIT, BUSINESS INTERRUPTION OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE GEMMA WEBSITE, EVEN IF UBC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU WILL INDEMNIFY, DEFEND AND HOLD HARMLESS UBC, ITS BOARD OF GOVERNORS, FACULTY, STAFF, STUDENTS AND AGENTS FROM AND AGAINST ANY AND ALL LIABILITY, LOSS, DAMAGE, ACTION, CLAIM OR EXPENSE (INCLUDING ATTORNEY’S FEES AND COSTS AT TRIAL AND APPELLATE LEVELS) IN CONNECTION WITH ANY CLAIM, SUIT, ACTION, DEMAND OR JUDGEMENT ARISING OUT OF CONNECTED WITH, RESULTING FROM, OR SUSTAINED AS A RESULT OF YOUR USE OF THE GEMMA WEBSITE.

5. Trademarks.

Trademarks (including unregistered trade marks) and names mentioned on the Gemma Website are the trademarks of their respective owners. You are prohibited from doing anything to infringe or prejudice rights of trademark owners. No right, title or interest in or to any official mark, prohibited mark, trademark, service mark, logo, or trade name of UBC is granted to you under these UBC Terms of Use.

6. Links & Endorsement.

The Gemma Website may contain links to other websites. Those websites are not under our control and we do not endorse and are not responsible for anything on those websites, including text, images, graphics, email, alerts, notifications, executable applications, software, underlying HTML, or other content, services and other policies including privacy policies, if any, offered through those websites by the providers of those websites. 7. All Disputes To Be Resolved in Vancouver, B.C.

The Gemma Website is a British Columbia website, and these UBC Terms of Use, (and all disputes arising out of or relating to these UBC Terms of Use) will be governed and interpreted according to the laws of British Columbia, Canada without regard to its conflicts of laws rules. You agree that by using the Gemma Website and the UBC Services and accepting these UBC Terms of Use you submit to the exclusive jurisdiction of the Courts of competent authority in the City of Vancouver, Province of British Columbia, Canada. Any acceptance of your application for UBC Services takes place in Vancouver, British Columbia, Canada.
